just because she is 18 doesn't make her emancipated - she doesn't become the age of majority until she is out of school. He legally can not leave her to live in that apartment by herself. You can easily prove his motivation for custody is her money. If she gets it before she is out of HS, since you are the legal guardian it should go to you to hold...or at least manage.

FYI - he can't move a minor into a vacant apartment - they have to have supervision. If he does, call child protective services. It would be great if he actually said that to you in an e-mail. If you correspond with him in that manner at all, try to trap him into saying it again. He'd be spending more money trying to get 2.5 weeks of "support" than he'd actually get.
