PRIZES: Smallponds, Inc. ("Smallponds" or "divorce360.com") is the operator of the Web site www.divorce360.com (the "Web Site"). Pursuant to the Question of the Day Promotion (this "Promotion") and in accordance with these Official Rules, Smallponds will give away a $100 amazon.com Gift Card during each business day of March, 2008 (individually and collectively, the "Prize"). THE TOTAL MAXIMUM VALUE OF THE PRIZES AWARDED PURSUANT TO THIS PROMOTION IS $2,200.00.

ENTRY PERIOD: A new daily Promotion begins at 9:01 A.M. Eastern Time each business day (Monday, Tuesday, Wednesday, Thursday or Friday) of the month of March, 2008 and ends on the very next day at 9:00 A.M. Eastern Time (each such period, a "Promotion Period"). For example, the first Promotion Period starts at 9:01 A.M. on March 3, 2008 and ends at 9:00 A.M. on March 4, 2008 and the last (and twenty-first) Promotion Period starts at 9:01 A.M. on March 31, 2008 and ends at 9:00 A.M. on April 1, 2008.

HOW TO ENTER: Subject to the "Conditions of Entry," below, there is only one (1) way to enter this Promotion. Registered members of divorce360.com who log in to comment at the Web Site and submit for posting on the Web Site an answer to the identified question that is posted (the "Entry Submission") in the Community section of the Web Site and selected by divorce360.com are automatically entered into this Promotion. Once the registered member submits the Entry Submission, the Entry Submission is final and may not be modified or further edited. The entrant to this Promotion will be the registered member under whose user name or site nickname the Entry Submission is submitted.

SELECTION AND NOTIFICATION OF PRIZE WINNERS: Subject to these Official Rules, registered members of the Web Site will be able to vote on Entry Submissions by clicking on the "good stuff" icon on the Answers page located in the Community section of the Web Site. Votes on each Entry Submission are limited to one (1) vote for each Entry Submission. The eligible entrant with the Entry Submission receiving the highest number of good stuff votes, as determined in the discretion of Smallponds, in a Promotion Period wins a Prize. If there is a tie between or among Entry Submissions as to highest number of thumbs up votes for an applicable Promotion Period, then the winning Entry Submission shall be selected by random drawing by Smallponds from such tied Entry Submissions. The Prize will be awarded no later than April 15, 2008.

On or about forty-eight (48) hours after the determination of each winner of Prize (each, a "Prize Winner"), the Prize Winner will be notified by email that he or she won. The Prize Winner must claim his or her prize within one (1) week after receipt of notification by contacting contest@divorce360.com and complete the Affidavit (as defined below) within twenty-one days period of the end of the applicable Promotion Period.

If a potential Prize Winner fails to claim his or her Prize within one (1) week after receipt of notification or complete the Affidavit (as defined below) within twenty-one days period of the end of the applicable Promotion Period, is found to be ineligible, or fails to comply with these Official Rules, the Terms of Use, Privacy Policy, or any of the requirements, the potential Prize Winner will be disqualified and an alternate potential Prize Winner, who will be the entrant with next highest number of thumbs of votes from the remaining eligible entries, at Smallponds’ sole discretion, will be contacted. Decisions with respect to the Prize Winner and other matters pertaining to the Promotion shall be final.

CONDITIONS OF ENTRY: No purchase is necessary to enter this Promotion. This Promotion is open only to persons who are (i) legal United States residents and citizens, (ii) eighteen (18) years of age or older, and (iii) valid registered members of divorce360.com. Employees of Smallponds and their respective immediate families, including household members, agents of Smallponds and their respective affiliates, parent organizations, subsidiaries, divisions, trade partners and other vendors, and advertising and promotion agencies and associated marketing firms are not eligible to participate in this Promotion. Smallponds reserves the right to verify eligibility qualifications of each Prize Winner (as defined herein). Limit one (1) Entry Submission per each Promotion Period for each registered member of divorce360.com.

Persons attempting to circumvent these conditions of entry are not eligible to win the Prize. Any attempted form of entry into the Promotion other than as described herein is void. Entries that are in violation of these Official Rules or the Terms of Use or Privacy Policy posted at the Web Site will be disqualified. Smallponds reserves the right, in its sole discretion, to void any or all entries of an entrant who Smallponds determines, in its sole discretion, has attempted to, does or has tampered with or impaired the administration, security, fairness or proper play of this Promotion.

Each registered member of divorce360.com is only eligible to win one (1) Prize during this entire Promotion. An individual is only allowed one registration, so in effect, an individual is only eligible to win one (1) Prize.

Any use of robotic, automatic, programmed or like methods to click on the "good stuff" icon will disqualify such Entry Submission and/or the individual using such methods. Furthermore, Smallponds reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if he or she fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

ODDS OF WINNING: Odds of winning will vary depending on the number of eligible Entry Submissions posted on the Web Site and will vary depending on how many eligible Entry Submissions are voted upon.

CONSENT TO PUBLICITY: Except where prohibited, entry for the Promotion constitutes each entrant’s consent to Smallponds’ use of his or her name, and biographical information (including, without limitation, hometown and state) for promotional purposes in any media without further payment or consideration.

REQUIREMENTS OF THE PRIZE WINNERS: The Prize Winner will be required to sign an Affidavit of Eligibility and Release of Liability for Participation, Publicity and Use (the "Affidavit") prior to and as a condition of acceptance of a Prize. If the Affidavit and all required documents are not completed as specified, are not received by Smallponds within fourteen (14) days of notification, or if after Smallponds’ receipt of the Affidavit from the Prize Winner, the Prize Winner is found to be an ineligible entrant, the entry will be disqualified and an alternate potential Prize Winner, who will be the entrant with next highest number of thumbs of votes from the remaining eligible entries, at Smallponds’ sole discretion, from among all remaining eligible entries will be contacted.

TO RECEIVE PRIZE WINNER’S NAMES OR OFFICIAL RULES: To request the name of the Prize Winner, available thirty (30) days after the end of each Promotion Period, or a copy of these Official Rules, mail your request, along with a self-addressed stamped envelope to divorce360.com Question of the Day Promotion, Smallponds, Inc., Attn: Contest Supervisor 760 US One, Suite 102, N. Palm Beach, FL 33408. Requests received more than ninety (90) days after the end of the last Promotion Period will not be honored.

GENERAL CONDITIONS: Florida law governs this Promotion. Void where prohibited. Smallponds reserves the right to cancel or modify this Promotion if fraud, misconduct or technical failures or any other factor beyond Smallponds’ reasonable control impairs the integrity of this Promotion, as determined by Smallponds in its sole discretion, or if a computer virus, bug or other technical problem corrupts the administration or security of the Promotion as determined by Smallponds, in its sole discretion. In such event, Smallponds reserves the right to award each Prize at random from among any eligible Entry Submissions received up to the time of the impairment or in any other method selected by Smallponds in its sole discretion. Smallponds reserves the right in its sole discretion to (1) change the dates of any Promotion Period of this Promotion, with or without notice, in the event of technical failure, or for any other reason and (2) disqualify any individual that tampers with the entry process or the operation of this Promotion, violates these Official Rules, the Terms of Use, the Privacy Policy, or acts in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage or undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. If disqualified, Smallponds reserves the right to suspend and terminate such person’s eligibility to participate during any or all Promotion Periods for any of the above abuses. Smallponds’ failure to enforce any term of these Official Rules, the Terms of Use or Privacy Policy shall not constitute a waiver of Smallpond’s ability to enforce its rights. Any taxes due on the Prize won will be the sole responsibility of the Prize Winner. The Prize is non-transferable, except in accordance with the laws of descent and distribution. Smallponds reserves the right to substitute the Prize with another prize of comparable or greater value. Smallponds will not enter into correspondence, including email, regarding this Promotion.

DISPUTES: Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action, and exclusively by the courts of record in the State of Florida in Palm Beach County or the United States District Court, Southern District of Florida; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will an entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, indirect, special, incidental and consequential damages and any other damages (other than for actual out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Smallponds in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida. All Florida state and local laws and regulations apply.

INDEMNIFICATION AND RELEASE: Entrant agrees to defend, indemnify and hold Smallponds and its representatives, attorneys, assigns, agents and licensees and their respective affiliates, equity holders, officers, directors, managers, agents, co-branders, associated marketing firms, advertisers and sponsors or other partners, and any of their employees (collectively, the "Released Parties"), harmless from any and all rights, demands, losses, liabilities, damages, claims, causes of action, actions and suits of any kind whatsoever (no matter whether at law or equity), fees, costs and attorneys’ fees (including appellate level) whatsoever (each, a "Claim," collectively, "Claims"), brought or asserted by any third party against any of the Released Parties arising out of or in connection with the entrant's Entry Submission, or the entrant's conduct in creating an Entry Submission or otherwise in connection with this Promotion, including but not limited to claims for trademark infringement, copyright infringement; violation of an individuals right of publicity or right of privacy, or defamation.

By entering this Promotion, entrants agree to release, discharge and hold harmless the Released Parties from and against any claim, cause of action, or damages (including, without limitation, publicity and privacy right claims) arising, indirectly or directly, out of entry or participation in this Promotion or receipt, use, or misuse of the Prize. Each entrant further agrees to release the Released Parties from any and all Claims that any commercial, advertising presentation, Web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Smallponds infringes the entrant's rights with regard to any elements, materials, ideas or otherwise contained in any Entry Submission.

LIMITATIONS OF LIABILITY: Smallponds is not responsible for: (1) technical failures of any kind, including but not limited to, the malfunctioning of any electronic equipment, computer, Internet, Web site, network, hardware or software, (2) unauthorized human intervention in any part of the entry process or this Promotion, or (3) electronic, human, equipment programming or other error, omission, interruption, defect or delay which may occur in the administration of this Promotion or the processing of any Entry Submission, votes made on Entry Submissions, the Prize, or these Official Rules, or in any Promotion-related advertisements or other materials.
