You're right. The property settlement gives me exclusive use of the property for the next five years and I pay all maintenance and payments.  The divorce was final on Dec. 11 of 08. He left with a paid for Jeep and no bills. I took over the bills because they belong to the farm I am living on. I started paying all the bills in March of 07 and the escrow acct. is from July of 07 to July of 08.
But the mortgage co. won't know that. They did tell me I could send a copy of the settlement agreement for their records. We have the settlement agreement filed in every place it needs to go so he can't try to put it up as colatteral (sp) on a loan.
He is just vindictive enough to not sign the check to spite me. Even though he had already married someone else he for some reason didn't want a divorce. I suspose I can call the mortgage co. and ask what they will do when the check is not cashed. It will come to my P O Box. I still have to send him his damn mail because he won't put in a change of address. I don't think I can legally do that.

Both of your names are on the mortgage, both of you have to sign it - regardless if you are getting divorce and actually even moreso BECAUSE you are...they won't change it.

How would they know it all should go to you? Unless you have a court order stating the unused portions are to be returned to Trisha - then their hands are tied.

 

I know you are anxious for the money but give the guy 24-48 hours to call you back.
