Please help!...Someone must know about this...

hello I need help and answer's to a question I just read in one of the post that in the state of PA if you file for a divorce if one of the persons getting the divorce does not want the divorce and does not sign you then have to wait 2 years before you can move forward and have the divorce granted. Is this true??? If me or my husband file and if one of us doesn't want it, they can just don't sign and the other then must wait 2yrs, I tried to look on my PA website but I just don't understand it. I need to hear it from someone on this site that knows about this and can explain it to me in plain terms ( sorry that's why my name is very-clue less) Thank you to anyone who can help me understand this .....

Are you divorcing with or without cause? Without cause in PA, yes, he can delay the divorce for 2 yrs. (Maryland is 1 year, FWIW.) With cause, though, you should be able to push it through over his objection. (In MD, I cut the wait down to 5 months with an "Adultery" divorce.)

Clueless, I am an attorney but I don't practice in Penn.

The two-year waiting period is for no-fault divorces.  In PA, unlike many states, it appears you can obtain, in some circumstances, a "fault" divorce in which case the two-year period of separation does not apply.  You would need to check with an attorney in PA to see if those circumstances might apply in your situation.

And yes, the answer to your question is that if one of the parties does not consent, generally the waiting period in PA is 2 years.  I am also in PA - where are you?

I have heard the same thing. Do you have an atty? If you do they can tell you. Why do you ask? Are you expecting trouble with your divorce?
