Afraid of having to pay spousal support with money i won't have.

I'm getting divorced from a short marriage (13 months).  I have an advanced degree, and my wife has no further education or skills outside of a HS diploma.  We have no children together.  She worked fulltime time as a clerk for a good portion of the marriage but during the last 4 months has worked only parttime or no-time (when she had been fired).  Let me add while I make more money than she does, I also have a large sum going out each month in students loans, so I don't really see a large portion of the money I make, leaving me with enough to eat, pay on my  car to drive to work, get a moderate apartment and save a small bit each month.
  We agreed on how all joint debts and property would be split and are attempting to do a divorce without lawyers as neither of us has the money to afford one.  If she doesn't ask for spousal support specifically would a judge award it to her anyways during the final hearing?

It's a short marriage but you have better earning capability and she is now unemployed. She should probably get short term rehabilitative help until she gets a job. That may be what the judge will say. Keep it specific for how long.

I also agree that for such a short marriage you would not be paying spousal support. She's obviously capable of working and that plays a large part in the decision also. Spousal support is meant in cases of one spouse not working for a number of years due to kids, or it was a joint decision for the spouse not to work in order to support the other spouse's occupation/needs, not because she was fired and hasn't found a new full time job in 4 months. Even if she asked for it, I wouldn't agree to it.

I agree....for 13 months I doubt he would award anything and if so it would only be a little bit and probably for only a very short time.  I would not worry, but you do need to get legal advice to  be certain.
