It's called divorce by advertisement or publication. It can be done, in a case where one spouse is missing. First, there must be documented attempts to have the spouse served (i.e. certified mail, process server etc.). Then the filing spouse must sign an affidavit stating that s/he does not have knowledge of the missing spouses whereabouts. Once that is done, an ad can be placed in a local circular for publication for 30 days. If there is not contact by the end of the 30 days, a default judgement will be granted.

It could be done even if the person who files knew where the other spouse was. For some states it just requires publishing in a local newspaper where the spouse was last known to live. But it wouldn't be legal. I think my ex has done that in Texas while we had a pending divorce in SC. It will eventually catch up with him.

i keep hearing things like this...and i'm not sure, but i think it only relates to people who are MIA.  but since you two are obviously in communication,  you would need to get the forms and agree on terms and sign paperwork, etc.  are there any kids?  a house? etc?
