Money husband has made since separation/am I entitled to any?

My husband and are separated and have gone to court for temporary custody hearing.  He informed me yesterday that he made $10,000.00 on a little side business he has been working on (mind you, we are in terrible financial debt and may lose our house)...anyway, am I entitled to any of that money?

He also took all of the money from our savings/checking account saying that was because he lost money on my cell phone contract.  The judge just told us last week to 1/2 the money.  I hate to make him angry but need to pursue this I am sure.  We are having a terrible battle over child custody..I wonder if I can use the money thing to get him to agree on the custody...money is part of his problem anyway.

Indeed you might.

If he did the business on his own as a sole proprietor (no corporation or anything), and since your divorce is not final, it would be treated as marital property until the decree is entered.  How much you would get would depend on your state's law and the judge's discretion generally.  By the way, if he goes and blows it, in most cases, the judge can definitely take that into consideration on any other property or maintenance you would get.
