Should New York Allow No Fault Divorces?

 

Sometimes marriages collapse without examples of abuse, adultery, or abandonment.  Sometimes things just die and nothing can bring it back. So long as you don't live in New York, Tennessee, or Mississippi, these are grounds enough for a divorce.

 

The "No Fault" (or Unilateral) divorce is the key. It gives couples the ability to leave a relationship that just isn't working before it escalates to one of the more damaging reasons.  Opponents say it's just an easy out and divorces will rise.

 

NOW-NYS, a feminist organization launched by Betty Freidan agrees. They say that by allowing unilateral divorces, New York will take away the one bargaining chip women have at getting a fair divorce settlement. This may be the first time NOW-NYS has sided with a pro-family organization.

 

Judge Sondra Miller believes this is incorrect, "Women are more susceptible to becoming trapped in bad marriages. A man at last resort has the escape clause of moving to a neighboring no-fault state, whereas women most often caring for children don’t.”

 

Both sides are gathering forces. This could be a long hot political summer in New York.

No, New York State should not allow no-fault divorce and neither should any other state.  Divorce rates skyrocketed when no fault divorce became the norm back in the 1960s I believe and women have much less protection.  Men can now pick up and leave for a tootsie in most states, and their wives have no recourse.  Of course women dump their husbands as well, but NOW is right in that it's usually the women who raise the kids.   If their husbands want a divorce in NY they at least have to make some concessions.  I am eternally grateful for NY divorce law because I live in NY, I was 60 when my husband left me for a younger woman, I had no income and no resources.   I got the house and alimony, at least until 65 (though it should have been longer).    In another state I might have wound up a lot poorer.    My attorney says no way NY divorce law is going to change, the legislature has fought this one out many times and there are too many vested interests who want it to stay the way it is.  I think other states should re institute at fault divorce so women have more protection.
