how recently? and how does he feel about you taking off with the kids?

if you haven't met residency requirements for the state you live in, you will have to file in the state you left. Bear in mind he has the right to petition to force you to move back, or give him custody of the children - if he wants to fight you on it.

I seriously suggest you retain an attorney in which ever state you qualify for your divorce in.
