Deferred Compensation from Public Company

Several million in future compensation. Is a marital asset? And how is the tax dealt with?

i suspect that to a judge, deferred comp looks alot like an IRA or 401k. while there is a way to "split" the 401k to avoid (immediate) taxation (Qualified Domestic Relations Order (QDRO), see here http://www.divorce360.com/articles/396/5-steps-to-splitting-the-money.aspx and here http://www.divorce360.com/articles/259/money-tips-protecting-your-401k-in-divorce.aspx ), I dont know about def comp.

I suspect it can be covered by a QDRO...

Given the amount involved i would talk to a CDFA (certified divorce financial analyst) check out the directory on the site - it has a list of financial analysts by state.

every divorce is different and if your spouse is aware of this potential future compensation, i'm sure they will bring it up during the proceedings. you should really contact a lawyer and tax specialists...also think about talking a divorce financial planner....that's quite a bit of money and i would want to know all the laws and my options. maybe someone else on this site has another idea here?
