NEEDING HELP ON SEPARATION/DIVORCE.
Her & the rest of Wayne's family are trying to get me for "ADULTRY", MARITAL MISCONDUCT, & BREECH OF CONTRACT". CAN THEY DO THAT? I MEAN I KNOW ALOT OF PEOPLE THAT DOES THAT. I'VE NOT MOVED OUT. NOT REALLY HAD THE TIME TO. I CAN MOVE OUT LITTLE BY LITTLE THIS WEEK. I was just wondering something that you might help me with... Being pregnant by another man before you are divorced? Adultry? Another question..... Don't you feel kinda stupid being enagaged to one man while you are married to another? Why don't you just file and get a divorce from Wayne? I will give you a bit of advice..... File and get a divorce, cause if you wait on Wayne to do it he'll make it where you pay him cause he is the one to have grounds..... Thanks and take careLynn, Waynes sister in law Congrats on your son.... I don't have a beef with you but you really do need to divorce Wayne. He is so much better than all this. You just hung yourself with the nice pictures of the baby. Just know I have copied all of them for his court case. Don't worry about filling the papers, he gets out soon and I will help him pay for it. I know for a fact he can get you for breech of contract, and make you pay him spousal support. Oh and did you know that your soon to be husband Michael is a registered sex offender? I believe they have laws to protect innocent children from being around men like that. YES Wayne has a court case, YES you can be made to pay spousal support. Just like if a man is made to pay for his ex wife it goes both ways. And with your threats and all, honey you are barking up the wrong tree. I don't care about you or your family, I could care less about anything you do or say. And as far as me paying for YOUR divorce, HELL NO!!!!! Get a job or sell your ass I don't care but you my dear will pay for your own damn divorce, and you need to stop telling Viola she needs to buy you phone cards and using the daughter in law to try and get your way, You are nothing to her, but my advice to Wayne is going to be NOT to sign nothing that comes to him. You wanted to get married, couldn't wait to get married, well you will stay married for a little longer. OK Take careFault:A spouse must commit one of the following acts: (1) Abandons his or her family. (2) Maliciously turns the other out of doors. (3) By cruel or barbarous treatment endangers the life of the other. In addition, the court may grant the victim of such treatment the remedies (4) Offers such indignities to the person of the other as to render his or her condition intolerable and life burdensome. (5) Becomes an excessive user of alcohol or drugs so as to render the condition of the other spouse intolerable and the life of that spouse burdensome. (6) Commits adultery. (North Carolina Statutes - Chapter 50 - Sections: 50-5.1 and 50-6)This is from the divorce website for north carolina....Read #6....Now if you read the next part you will see #1...Marital misconduct? You committed marital misconduct by having a baby with another man while married to Wayne, VERY easy to prove. So get your case together cause you will need all the back up you can get. Now make sure you read this all very slowSpousal Support: Not all cases involve support from one spouse to the other. The obligation of one spouse to support the other financially for a temporary or permanent basis is decided on a case-by-case basis as agreed to by the parties or at the court's discretion. The court shall exercise its discretion in determining the amount, duration, and manner of payment of alimony. The duration of the award may be for a specified or for an indefinite term. In determining the amount, duration, and manner of payment of alimony, the court shall consider all relevant factors, including: (1) The marital misconduct of either of the spouses. Nothing herein shall prevent a court from considering incidents of post date-of-separation marital misconduct as corroborating evidence supporting other evidence that marital misconduct occurred during the marriage and prior to date of separation; (2) The relative earnings and earning capacities of the spouses; (3) The ages and the physical, mental, and emotional conditions of the spouses; (4) The amount and sources of earned and unearned income of both spouses, including, but not limited to, earnings, dividends, and benefits such as medical, retirement, insurance, social security, or others; (5) The duration of the marriage; (6) The contribution by one spouse to the education, training, or increased earning power of the other spouse; (7) The extent to which the earning power, expenses, or financial obligations of a spouse will be affected by reason of serving as the custodian of a minor child; (8) The standard of living of the spouses established during the marriage; (9) The relative education of the spouses and the time necessary to acquire sufficient education or training to enable the spouse seeking alimony to find employment to meet his or her reasonable economic needs; (10) The relative assets and liabilities of the spouses and the relative debt service requirements of the spouses, including legal obligations of support; (11) The property brought to the marriage by either spouse; (12) The contribution of a spouse as homemaker; (13) The relative needs of the spouses; (14) The federal, State, and local tax ramifications of the alimony award; (15) Any other factor relating to the economic circumstances of the parties that the court finds to be just and proper. (16) The fact that income received by either party was previously considered by the court in determining the value of a marital or divisible asset in an equitable distribution of the parties' marital or divisible property. (North Carolina Statutes - Chapter 50 - Sections: 50-16)You sent me a text email saying to leave you alone? Unlike the people you hang around with I am a very educated female and I don't take shit from people like you. So I will give you this advice, Stop now while you can, Stop all this emailing back and forth cause I am not a child and I am not afraid of you, All this he said she said is grade school stuff and I am beyond that. So from now on I have nothing to say to you, and you shouldn't have nothing to say to me. LEAVE it alone. Get it? Got it? GOOD
