States of confusion!

my husband and i got married in NY but now reside in tennessee.  but i am currently staying with a friend in NC and he is staying with his cousin in SC? how do i start the process? which state do i go threw? can anyone help me... and we have two kids to make things more complicated, they are staying with me...

wow!  you can file in the state you live in.  almost all states have a waiting period that you have to live there a certain period of time before you have established yourself and can file for divorce. 

i am not an attn, but a read a bit in NC law - looks like to me that the the residency rquirement is 6 mo.  you can get a no fault divorce if you have lived apart of a year, or get a fault based divorce. 

i would talk to an attn to get started - most have a free initial consultation and can review all the fault stuff,etc.....
