Divorce Journalism: Freedom of Speech or Muckraking?

South Africans no longer have the right of privacy in their divorces. The stories, details and names are now open for publication following a Supreme Court ruling this week.

 

This results from a ban placed by the courts on details surrounding a paternity fraud suit last year. A husband was suing his ex for damages after she told him that their son wasn't his.

 

A newspaper took the ban to the high court and Justice Nazeer Cassim found that the media section of the Divorce Act was unconstitutional, in that it violated the freedom of speech.

 

Now that the door's been opened, what personal details will the media sensationalize as it barges through? In the US we walk a fine line. Only the future will show how South Africa fares.
