child custldy

i'm not married but have a child and want to know what i can do to get full custody of my child. what rights do i have and what rights do the father have. can i be at fault if i was to move out of state with out the father knowing?

ok...

the RO possibly complicates things a little bit...

what was the RO for? was is just for you or was the child named too and why? If the child wasn't named, why have other arrangements not been made for him to see the child?

you should be able to move w/o his permission - but you will have to notify him - as he does have the right to contest it...but let me know about the RO....to be sure.

he's the father but not paying child support. i have a restraining order against him so he hasn't seen the child for a year now. in california

was paternity established and is he paying child support? Does he spend time with the child? What state are you in?

I would request full custody of the child first of all. The father has rights too but all you can do is state your case. I think with no one showing as having full custody, im not sure they can do anything. However, if he files for custody after you leave, you may have to come back.

First of all do not move away without the father knowing you could be charged with kidnapping.  "honesty is the best policy".  You do not want your child taken away for good when you are caught.  I am not an attorney so I would seek legal advice on this situation since you both have rights to the child.
