Who should file, me or him?

Does it make a difference who files?  My husband wants to use one attorney but every attorney I speak with says they can only represent one person and not both of us.  I am terrified of taking that first step but feel I need to be the one.  Can anyone explain this to me?

DO a Google search for collaborative divorce.

My stbxh and I both visited attorneys and found we were able to agree on everything.  We are doing our divorce on line.  In our county - we don't even have to go to court.  We just send in the papers.
VERY easy and inexpensive.

contact your state bar association for a referral to an attorney willing to do a collaborative divorce.

most don't want to because if one or the other party has a problem down the line, it can't be properly represented.

If you have children, I advise you two seek yuor own counsel.

I also live in Mo..  If the divorce is amicable and the settlement is agreeable to both, you can use the same attorney.  My stbx and I are.

I did an internet search for divorce mediators in the state where I live and I found some right away.
Good luck!

There are lawyers and mediators out there who will work with both of you, but basically you should work out everything on your own to be able to do this.  The lawyers or mediator or collaborative divorce (in CA) are much cheaper but I think you end up doing most of the work.
