Does anyone know if you win a lottery and you have been living apart from your spouse for over a year is he entitled to half?

why risk the problem with the IRS? why not file married but seperate? If you have to revise it later so be it - but for right now, don't make things worse for yourself by not filing.

Thank-you so much for taking the time to help all of us on this board. I have spent $20,000.00 on legal fees and still no divorce. I have not files taxes in 2 years waiting for spouse to give me W-2's and make an agreement on other items. I am just wiped out financially and mentally and don't want to have to share this $5,000.00 with him. I know he has been hiding money for years but can't prove it. It's all cash. So again thanks for your help. God will bless you.

ok, looked into it - lottery winnings while legally separated in VA are not subject to split or constructive trust at the time of divorce.
and there is case law on it.

depends on what state you live in...post it and I'll let you know...
if you were legally separated, more than likely the spouse won't be entitield, if you are just living apart - there is a good chance the spouse is entitled, but not necessarily half depending on the state.
