He won't move and won't let me move with the kids

Does anyone know how to handle this?  I would prefer for my husband to move out, but he said he won't go.  He also won't let me leave with the kids.  What do I do?

Do it!  I wish I would have done that.  Now we are in the every other night with the children which has been awful.  I did not know about temporary custody.

you go to an attorney, you file for divorce (or legal separation depending on the laws of your state) and in the petition you request temporary custody of the children and control of the marital home which will force him to move.

OR

one day when he isn't home - you just move yourself and the kids out & you don't see or talk to him until he has been served with the divorce papers, and the court has given you temp custody of them.

this isn't about him "letting" or "not letting" you do something - you have rights, and one of them is that he can't control you.
