Need some help

My wife is a out of control Drunk! She has been in rehab three times in the past two years. Has gotten two DUI's, been hospitalized numerous times. The last time in intensive care with BAC of 5.96. She has not worked in over three years and says if I leave her she will call the police on me for deseration. I want out, I am sick of this but I don't want her to take me to the cleaners when I am trying to get out and start over. Need some advice

ok - TN recognizes both fault & no-fault divorces - if you just want out - the best route to go is a fault divorce citing her alcoholism - doing so, she can't take you to the cleaners because you can prove her 3 years of unemployment wasn't by your choice, it was due to her drinking - and having been her "fault" for the divorce - her entitlement in the "equitable distribution" is far less - and due to her conduct in the marriage - it negates her ability to collect alimony.

You don't want to file no-fault, even though it is faster, because then she could get alimony.

go see an attorney asap so you can move out and get on with your life.

I live in Tennessee, The good news is the only assets we have is My Pick up truck which is not in her name. We filed for bankruptcy in 2004 after we purchased her dream home which we could not afford. When we met I brought with me, a dresser, a twin bed and a desk, plus my sports, tools and camping gear.

The lease is in her name, (I refused to sign it after he first year)

Electric bill and water are in my name.

ok, leaving your wife is not an arrestable offense. Go see an attorney and file for divorce and get on with your life. You deserve to be happy.

if you want to get an idea of what you are going to have the deal with  - what state are you in and what assets do you two have?
