Help a Man Out

Tricky one here. I am Sole Provider for my Family my Wife works Parttime 200/Month We live in San Diego. I am wondering if there are any laws to stop me from taking my kids when we seperate. I have heard that since no Order is in Place it is equal for both parents. Just whop is quicker on the draw.... My conscern is I left once before and had to move back for financial reason so I stabalize my kids. So I know when I leave again i will not be able to pay both rents again// Any Advice

I agree with spaznskitz.  The kids need to spend time with their mom especially if she is the sole care-taker.  Is she an unfit mom?  Why not go for shared custody?

No there is nothing prohibiting you from taking them with you - you just can't withold them from her.

 

can I inquire why you don't want her parenting the children when she has more time to do it than you do? Is the rent the only reason?

 

Since the kids are used to being with mom more, is this choice going to traumatize them in any way?

 

not discouraging your choice, I just want to ensure for the sake of the kids it isn't being done just  to be vindictive to your stbx.

the kids wants and needs have to come first.
