When Is a Statorey Declaration Legal?? HELP NEEDED URGENTLY PLEASE!!!

If I had my ex. signed a Stat. Dec. and it was witnessed and signed legally, can he contest it?
It stated he accepts a one off cash payment and furntiure, but now he wants more money!!
I didnt know I had to send it to the courts and have just kept it in a safe place. It has been 15months since he signed it so is it too late to put it into the courts now? And what are the right channels so to speak to go about it.
So can I use this agreement between ourselves in court if needed and will it be of any help to me if I do?

Thanx and yes it was a pharmacist who wittnessed it and signed it.

Good Idea I will take it to the courts asap. As my divorce is being filed or heard without me being present on the 13th May 2008.

So will let you know how it goes.

uh oh - chemist as in pharmacist? (i hope)

according to my readings - it can only be witnessed by someone who is licensed to practice any of the following - I want to make sure you even have a valid document in the first place...

  • Chiropractor
  • Dentist
  • Legal practitioner
  • Medical practitioner
  • Nurse
  • Optometrist
  • Patent attorney
  • Pharmacist
  • Physiotherapist
  • Psychologist
  • Trade marks attorney
  • Veterinary surgeon

  • that said - I did some reasearch (I'm in the states so this is an educated guess on my part based on what I read) and I don't see where a declaration expires to where you woudln't be able to submit it - however, since it has been over a year - his defense could very well have it stricken.

    file it and see where it gets you - it can't hurt.

    Im in Victoria Australia and I had a chemist wittness it, but  didnt have it filed to the courts! I didnt know I had to do this. And now he is asking for more!
    Where do I stand. Pls help.
