leave or stay

if im in the process of a divorce and my husband is treating me bad and if i leave the house or move out before the divorce is final am i still entitled to my share of the property even if the house is in his name only

however, most states have an abuse dictum..if you are beng abused and unable to stay in the marital home, make sure you get everything documented, even if it means calling the police to have record of abuse there, going to a shelter or somewhere else for your own safety.. keep a journal of all incidents (time, date, description of the incident, etc)..in Virginia if the house was his property before the marriage and your name has not been added to the titlle and/or deed, you are out of luck.. if it was bought during the marriage & your name is not on it, you may have a little more to stand on even though Virginia is not a community property state because it was bought with marital funds...check with the bar association in your state to see if they have attorneys that represent women only and they may be able to assist you.. we have a company such as that in Virginia and they have taught me sooooo much that i didn't even think about prior to my disaster.  good luck!

usually. some states have laws about this though, so double check. there's a white box with information center in it. check there.  what you divide in a divorce depends on the state you live in, how long you've been married, debts, assets,etc.
