regarding the post below - your attorney is only as good as how much time you invested in choosing them.
KY is an "equitable distribution" state - what that means is that any assets that the two of you can not decide on your own what you want to do with, the court will take several factors into consideration to determine the split. The most important factors are as follows:(1) Contribution of each spouse to acquisition of the marital property, including contribution of a spouse as homemaker; (2) Value of the property set apart to each spouse; (3) Duration of the marriage; and (4) Economic circumstances of each spouse when the division of property is to become effective, including the desirability of awarding the family home or the right to live therein for reasonable periods to the spouse having custody of any children. It may not end up being 50/50 - but it will be fair based on the factors above...I'm one of those awful rotten terrible attorneys only out for money....not! =)
