I need help!

I have a question. I purchased my home before I got married. The deed is in my maiden name and I never added my spouse to the deed. We have been married for 2 years but I moved out in Feb 08 and filed for a divorce and put the house under bankruptcy because I fell behind in the payments. My problem is that my spouse won't leave the home & is fighting against the divorce. I have an attorney , but she isn't much help with this situation. I live in GA if anyone has any info please help.

GA family law states:

§ 19-2-3.  Domicile of married person 

   The domicile of a married person shall not be presumed to be the domicile of that person's spouse.


The house was yours before you married the guy - legally evict him. Don't go through your divorce attorney, hire a real estate attorney to oust him.

Get a new lawyer. A good lawyer is the most important thing for you and your future. A lawyer can either make your life better after the divorce is over and make you wish every day that you'd gone with a different attorney. I understand the cost involved - I've been there too. But in the end it's what you may have to do.

Also, do go to the police and explain to them the situation and get there advice. But if the house is going through Bankruptcy any ways - he will be forced out of the house by the authorities when it's all over if he won't leave on his own.

I don't live in GA, but if your attorney is not willing to help you....I'd look into getting a new attorney.  Are you trying to keep the house?  If not, move out.  You may want to touch base with your local police dept. and see what they have to say.  If your husband becomes aggressive file for a Civil Protection Order and he'll be forced to stay away from you.  In the end it's just a house.   PS, document everything!!!!
