Relocation from Texas to California?

I live in Texas and was recently divorced.  I want to relocate to California, where I will have more family assistance in finding a better job and more emotional support for both my son and myself. Does my twelve year old son have any legal say in this decision or will we both be forced to remain in Texas near his father until he is eighteen?  My X husband has already missed the first month's support payment & only sent a fourth of his payment for April, which was 10 days late.  I will receive an eviction notice in May, as my job as a janitor will not support us.  My lawyer says his lawyer tells her that he won't even respond.

Texas is extremely tough on parental move aways - they are very family oriented and force divorced parents to stay very close to each other for the sake of the child. It is firmly believed by Texas officials that it is detrimental for a child to be separated from a biological parent unless there is proven abuse.

the fact he is late on child support has no bearing on custody or visitation.

Children do not have a say on where they live. There is only one state that has statutes giving children rights to choose, and that is Georgia at the age of 14. All others are at a judge's discretion based on testimony and in TX, if one parent objects - you can not go.

In fact, if you don't get your living situation squared away, you could lose custody to your ex if oyu do get evicted. Contact your landlord and see what you can work out.

my friend has a similar situation - her husband doesnt pay any child support (he owes a lot, he just doesnt pay!) and yet she must stay in the county, regardless of his payment - or non-payment...
She was trying to trade something he wanted (not to pay) for allowing her to move to take a better job (something she wanted).  he didnt go for it....
