asset dividing

My best friend is going through a divorce and her childhood home was signed over to her by her parents. It happened while they were married. Can he stake claim to it even though it was signed over to her only?

in virginia if was left to only her, he has no claim to it. if he claims she pid for it in some way while they were married then he technically has a stake in it since it was paid for with marital funds...but it all depends on what state she is in and what state the property is in.

if it was truly gifted with no monitary exchange, he can't claim it. If even a dollar was exchanged, it is technically a sale and he has full rights.

If is was held and run separately, usually no.  asset division can vary state-to-state. (Im not an attn, just a lot of time on here!)  This is def worth using a lawyer for, even if you just use them to consult for an hour or two - as for the cost, i'd trade a few hundred bucks for a house any day!
