illegal alien

My husband and I have been married for 11 years, he is undocumented and has been deported two  times and has come back.

When I first met him he had been deported once, and entered again illegally,We married I paid to get him legal, he had a green card that he let lapse, he was deported again for the second time. He has returned again illegally.

He is also married in Mexico

Now we have a lucrative lawn service and he has cheated on me many times, I have proof I caught him in the bed once and now his girlfriend has called me and he has acknowledged the fact that she is indeed his girlfriend and he has asked her to marry him and have his baby.  He is 50 she is 26 I am 52 go figure.

The question is about my house that has been in my family for years.  My brother was owner of my house and we, were buying the house from him we paid some on the house together, but then my father died and left me enough money to pay my house off and I did just that I paid the house off.

The property consist of a house and two rental trailers.  Since my husband and I took out a home improvement loan of $25,000 which he left before the first payment was made.

He left, he took the business and all of the equipment that we own and he keeps all of the money, he has not paid anything on the loan or the bills for the house or taxes

Now he has left his girlfriend, and he moved into one of the rentals on the property and he is not paying rent which takes money away from me.

My question is with him being illegal in the country, married in Mexico before we marrieed, he cheated run off with a younger woman etc....does he have any claim to my property?

go to your phone book and look under private investigators - have them look into his possible other marriages.

do you have proof he is married in Mexico? can you get a copy of his marriage certificate or other legal proof?

You see, it doesn't matter if he was married in another country, he is guilty of bigamy, and that is a felony in most states. Your 11 year marriage is invalid - you were never actually and truly married.

You want him out of your house and your life? You bring proof to the police of your marriage to him and his marriage in Mexico and have him arrested. He will probably be deported - again.

You then see a lawyer about having your sham of a marriage annuled and he has no right to a damn thing.

Wow, it sounds like you really need some legal advice. Use the directory on this site, find a lawyer and get a solid legal opinion. This will at least relieve the anxiety of not knowing where you stand.

He just moved in himself without asking.

The lawyers that handled the sale of the house said it didn't matter if I put his name on the deed or not in the state of Tx it would be considered community property.  So his name is on the deed.

This was before I knew about the marriage in Mexico and I think he is also married in Iowa.  I don't know how to check this out.

You should talk to a lawyer, if he is not on the deed and your marriage is not legal, then you may not have an issue with the property....

Is his name on the deed of the house if not, call police get a restraing order,to stay away 100 yards,if he violates the restraing order hee can go to jail.Usally the restraing order is good for the first two weeks, then you go to court, and have it pushed up to a year, you as a woman wont need a lawer, just tell the court what you said here, married already before you got married, cought him in bed, left town ,now back again ,lets the court also no that you fear for your life, that should be the kicker to grant for the year, question how did he get back in the trailor?did you let him,or did he help himself.
