Where is she going to school?!

my ex-wife moved 30 minutes out of town to be with her 'soon to be husband' and wants to enroll my daughter in middle school where she is zoned. This is very convenient for her as she will be able to take the bus back and forth to HER house, even on my weeks. I just received a letter from her attorney requesting Mediation since the only point she sees is her own. I have applied for a variance to a Middle school where my daughter can continue to be with her friends and she is only 5 minutes from my work but she won't wait to see if I get the varience or not. How does a judge decide where a child goes to school when the parents can't seem to meet in the middle?

Update:  I got the variance the day before mediation.  I found out that my ex had gone to the school and requested she be notified if the variance was going to be granted.  It was granted the day before I met w/her so she had no idea.  The look on her face? Priceless.  Mediation was deemed 'unsuccessful' and I had to discuss it w/her later.  Now she has agreed and informed me that we would be back for High School.  I guess I will just have to get another variance.  Let this be a lesson to those going through this, put it in the divorce papers.   Thanks for the advice.

Thank you, I have 50/50 all, every other week I have my daughter and I pay child support.  I would also like to get that changed as her income has changed and I already pay the maximum for one child so it can't get any worse!  I guess they don't take any of that into consideration but the best interest of the child.  I think I will already have the upper hand as she is only thinking of herself and what is convenient for her and not my daughter's best interest.  The schools are in the same district and they both are in nice neighborhoods with high marks, but her school is a combined middle/high school.  The school I have applied for the varience is the same zoning she has been in, and most, if not all, of her friends will be going.  The variance will be the deciding factor and I am the first on the list, they say.  I contacted the court to reply to the 'request for mediation' and they had no record of it.   Weird.  I'm standing by for when mediation will occur (hoping the varience comes in by then)....Thanks again.

You don't state what your custody is, joint p/l, 50/50...

 

If it isn't 50/50, she will go to the school where the primary parent lives.

if it is 50/50, she will remain in the school district she has always been in, provided you get the variance to do so. Unless she can prove the school district she moved to is better than the one she is in now. (I suggest you look into it before you dig your heels in for a fight)

if you don't get the variance before it goes to court - it's pretty much a moot issue.
