How to settle the house?

My husband and I have been separated for over a year. We have decided it's time to start the divorce process. I moved out 1 year ago and he stayed in the house and has been making the mortgage payments.  Our 18 yr old and 20 yr old kids still live there and go to school. He can not afford to buy me out/nor can I buy him out. Neither one of us wants to sell the house for at least 3-5 yrs. Does this need to be an issue with the courts or is this something we can just draw up papers on and sign an agreement?

you can agree to anythig you want to - the court only gets involved when there is a dispute and an ultimate decision needs to be made.
