credit card.. am i responsible?

Husband had credit card in his name only before, during, and even now.  During marriage there were some purchases made on it to purchase household items.  He says I owe for half the bill. Even though he took the items that were purchased when he moved out.  I live in community property state.  But does that mean I am responsible for half of the bill for items I dont even have in my possession?

I answered this for you as well in "emergencies" but I wanted to also post it here for reference for others:

 

 

the answer to this is yes & no (nice, huh? lol)

this is one of those divorce points that couples end up bickering over for hours across a mediation table.

because the charges were made during the marriage and for marital property, yes, you would be responsible for half of the debt as pertains only to marital items -

however

since he took the items, that are half yourse due to being marital property, he has to make a choice, either return items to you of equal value to half the debt, or the debt must be his sole responsibility.

If he chooses to return items to you, make sure the balance of the bill is only for those marital items and not for any charges after he left - or other misc. charges he made on his own.
