child support

I have been seperated for 6 months and I want to filed for a divorce but I cant afford it, I am getting child support but it is not enough for 3 kids he wont give me any extra money cause he is to bust living the life in the streets I want a divorce but he says that he will not sign the papers so that will be $3500 dollars and I cant afford that so what do I do if I cant afford the divorce and he wont give me any more money I am working but it is part time. I dont care what he does I just want him to help me with the kids,he spends his money on every thing else but when I tell him that he needs to give me more money for the kids he starts to say what he cant do and what he has to pay. What do I need to do the state does not help you with any child support and it is shame that you have to hire a lawyer to get child support.

the state will help you with child support, but you have to be in the process of, or already divorced for them to be able to legally do anything for you - right now, you are still considered married, so thay can not go after him for anything.

Go to your local court house clerk's office and apply for legal aid claiming indigent status (unable to pay). Considering your status, I'm pretty sure you will qualify - the legal aid attorney will handle your divorce case for you.

Be aware though, unless you request that child support be GARNISHED from his paycheck from the start, you will continue to have the same problem getting money from him.

I would go down to your local courthouse and speak with the Clerk of Courts getting the divorce papers. There is also a "do it yourself" kit you can attempt and then maybe pay a smaller fee for an attorney to review it before it is filed. I am not an attorney so do not know for sure.  This website might even have the forms for you if I see them I will let you know.  In the meantime keep your head high and stay focused on building a better life for you and your 3 children.
You can also call Legal Aid, they give free legal help to people who need it.
