Filing Pro Se/No Assets/No Children

Greetings.

My husband abandoned the marriage four years back.  He cut me off last year financially so I figure if I start proceedings, I'll have a better chance of getting some kind of money from him once the divorce has been finalized.  I am struggling so bad it's not funny and of course he doesn't care.

Anyway, I was thinking of filing pro se since we do not have children nor any assets. As for alimony, I was going to let the court decide.  The only thing I am asking for is the truck which he left me with anyway.

I am also on disability so I can request a waiver on filing fees, so I am thinking that I should just go ahead and file on my own. I don't really believe I need an attorney or would I still?

Could it get ugly with nothing in the pot so to speak?  I mean wouldn't it be a waste of his money if he tries to contest it by hiring an attorney? There is nothing to contest.

Hi katt1010 - Even though you have no assets and no children, it would still be best if you at least had a consultation with a lawyer.  Most lawyers will have a fee for a half hour consultation but it's not very much.  I came from a small town and I consulted 3 lawyers.  I was trying to find one who didn't see my husband in a professional capacity.  I finally had to go out of town for my lawyer.  I didn't end up using any of them because each one of them gave me some advice I could use.  So, my former and I were able to finally reach an agreement on the settlement of our assets and filed Pro Se.  It is, I feel, in your best interest to get some legal advice.  There is a lawyer on this site but I can't remember her name right now.  I will check on it and let you know.  She may be able to help you figure out what your next step might be.  I'll be praying for you.
