friend in need

if a person is separated by incarceration of more then two years and is only a common law marriage and the woman is still married to her husband that lives in another state WHAT SHOULD SHE DO?

Answers for "friend in need"  (2) (You must be logged in to answer)
If she is still married to the man in the other state - she can not be considered in a common law marriage with the incarcerated man. She has no right or claim to anything in the status of a wife of the man in jail.

She only has to divorce the out of state man - the other situation she was in, was just her shacking up with a boyfriend (and essentially committing adultry)
