A Pakistani couple living in the US filed for a divorce in 2003. While the wife went to a Maryland court, the Husband went to the Pakistani Embassy. Pakistani courts ruled that the wife would loose access to her husbands pension funds. That's when the real legal battle began.
Farah Aleem, 46, took the case to Maryland court. She believed that since she was living in the US, she deserved the rights of other divorced American citizens. Maryland's District court agreed with her.
Her husband, Irfan, appealed to the Supreme Court, he didn't believe that Farah had a right to that money. After a long battle, the Supreme court sided with Irfan. The court ruled that although the couple essentially lived in the US, they were still both Pakistani citizens, and withholding pension in a divorce was not an unusual ruling even in America.
