help asap

my soon to be ex husband somehow managed to get full custody of our son. he sent the divorce papers to the wrong address on purpose knowing that we havent lived in that address for like four yrs now. i got the papers a day late. so that is how he got full custody. is this legal? how is it possible for someone who has multiple family cases on him to even get custody. and he has my address. oh yeah and not to mention they said that i owe child support now to him. how is that possible when we havent been to court on it???

I don't know if him purposely sending the papers to the wrong place is legal.  If it is, it shouldn't be. It is absolutely terrible that he would do something like that.  He probably knew about default divorces.  Meaning: if the respondant (you in this case) does not reply within a certain amount of time the person filing the divorce gets what ever they put on the papers that they were requesting.  This includes child support, visitation, alimony, everything.  I suggest you consult a lawyer in your area.  What he did was wrong.
