wife will not discuss a deal

i am going through a divorce and i have asked my estranged wife to come to an aggreament concerning joint finances/ property/ debts/alimony etc and she refuses to even talk to me about it , when we go to court will the judje decide how to split up the marital assets/ debts based on all our financial evidence

You might want to try mediation. Where I live the first three sessions with the mediator were free. He did a great job of being fair and objective with the assets. Once you both come to an agreement the arbitrator submits the agreement to the court, which usually accepts it. Of course, she would have to agree to this. Just tell her that it's as much to her benefit as it is to yours.

if you can't agree, it's likely the judge will decide based on such things as length of marriage, assets, salaries of both parties, debts, children et al. you should talk with an attorney from your state.
