Served with legal separation but wants divorce

My brother has been seperated from his wife for over a year now. He was served with papers but they were for just a legal separation. He wants a divorce. What should he do?

He lives in Colorado. I do not believe that there needs to be a separation before the divorce because they have already been seperated since 9/06.

I think it will depend on the State he lives in but I am pretty sure he can serve her for divorce  unless the State he lives in requires separation previous to divorce.
