taxes I filed my taxes the Irs told me my ex claim my college kids as living with him in 2007

If you had my college kids lived with me for the year of 2007 does my ex the right to claim them on his taxes as living with him

This gets tricky Maureen. Only sometimes does the custodial parent get the tax benefits. Usually the tax benefits are shared, with one parent taking them in odd years and the other in even years. Also, I've seen where the non-custodial parent takes them every year to qualify for the earned income tax credit.

Given the limited info you have provided, I'm assuming you claimed and the IRS rejected your your claim because your husband claimed them first? If so see a licensed tax professional H.R. Block is pretty good but a tad expensive. You might also contact the TaxPayer Advocate Office within the IRS and lodge a protest.

No... only one of you can claim them.... usually depending on who has the custody...
