Does it look better for him to file or me?

I was wondering if my husband has been having an affair, as I posted before and we do decide to file for divorce, does any one have any comments on who should file for the divorce.  Would it be better for me financially and through the courts eyes, to just let him file or should I just bite the bullet and do it myself?  He is moving out Friday and has no intentions of making our marriage work.  I am a stay at home Mom with a 6 & 1 year old.  Any suggestions will surely be appreciated. Thanks again everybody!

If you're just filing an uncontested no-fault divorce, there really isn't an advantage either way.  If you're filing a suit or anything there are advantages, but I'm the "friendly divorce" guy and I have no experience in that area.  I recommend you consult a lawyer.

I am so sorry.

If possible do not be there when he packs and leaves.  For me this was heart wrenching, I left and stayed with a friend.  Everything hurts enough, don't add to it.

Please read the note on your journal.  My thoughts are with you.

I am not sure what would be better of if it really matters... I think how it matters is that if you file... you may have more control that if you rely  on your husband...

Sorry to hear about your situation...
