Held Hostage By Spouse and Attorneys

My spouse of 36 years did not respond to petition or demands for information for almost 2 years.  My first attorney took a Calif. retainer and demanded a retainer for forensic attorney. He took $7,500 and accountant took $5,000.Attorney did nothing and is billing for another $7,000 plus interest.  Had to get a new attorney, another $5,000 and finally had to sign a lien on house for $16,000 and I am just finally getting to court on an Order to Show Cause.  I was told the other day that the courts are not required to give and order.  I feel like I am falling into a pit.  Almost out of money and living in home of friend.  How do we get protection from the legal system?

Hi linkie,

About the attorney who billed and produced little to nothing; contact your local County Bar Association and ask about fee disputes. I think the fee is to have the County Bar arbitrate a fee dispute is $243.00. You can also appeal to the State Bar which I think will do it at no charge. Here's the link;

I'm not sure about the canons and Rules of Ethics because I'm not a lawyer just a lowly paralegal. My guess is that an attorney who didn't file an OSC to answer interrogatories and/or produce documents for two freakin' years might be guilty of professional malpractice. check the attorney section of your yellow pages for "Professional Malpractice" attorneys and stat dialing until you find one who first take your call and second take your case.

Personally, I hope you hose that bad dog.

You may know the old saying... dogs don't eat dog... well that maybe the case with your current attorney (I apologize if an honest attorney happens to read this). I agree with Vicki you should push your current attorney and the Court to help you out with it... that said, good luck.
