friend getting a divorse...

  One of my best friends is getting a divorce, and his wife wants to set all these rules on him that in everyones opinion is crazy. First of all it was her that cheated on him, more then once. Though it was him that left. He is now dating a woman who is really good to him. His wife won't let him see his boys (2), except if she gets something out of it, and he's only seen them for 3 hrs in the last month. She now wants to settle, but he has to agree to not let anyone see or meat his boys for a yr and a half after he starts seeing them, and she wants him to wait for 5 yrs before he can get married. She wants all this in the divorce. My question... do they put this stuff in divorse papers? He is willing to do anything at this point, but his girlfriend is questioning whether she will stay with him if she can only be part of his life 4 days a wk. and cannot live her life the way they want but the way his ex wants them to. I told her I would find out if possible, and I feel responsible because they met through me, though they weren't "fixed up". They are both questioning the legality of all this... Thanks

Hi Bambi, what I will tell you pertains to California.

There are only two issues in a divorce. Children and property. That's it and that's all. Here, those demands wouldn't pass the laugh test. There are many good attorneys advertising on this website. Tell your friend to hire one and hose that bad dog.

My understanding is that she has the right to ask the same as your friend has the right to refuse... but that may drag the process for a much longer time till the divorce is final. In most States it is not wise for the husband (or wife for that matter) to start dating untill the divorce is final... so your friend maybe jeopardizing his chances of getting a favourable visitation settlement cause most judges would favour the custody to the mother anyway. I think you need to let your friend know that he should probably check that with an attorney. I just found this website today that he may find useful as well
