don't wanna loose property

my dad passed away his name and moms name on property and they have 7 kids mom wants to let youngest kids to get property he will loose it do all kids have to sign for him to have it or can she just give it to him ???? plese help
there is nothing  its just property that my parents have  and no will or anything was made up , both there names are on  it. there is 7 kids my mom wants to give to my youngest brother he wants to morgage it and we all know he will loose it , so we don't wanna sign it over to him , and my dad asked us not to lose it to anyone.

It depends how title is held lisafrank. Most married couples hold real estate in some form, depending on the State, in Joint Tenancy with Right to Survivorship. This means the surviving spouse, your Mom, will receive the property.

IF it is held in a Trust of some kind, as Lori-Woodal posted, it depends on what the Trust agreement says should be done with the house.
