It does not matter who "initiates" the divorce when determining child support, spousal support, or property division.  You will be able to make a claim for spousal support or for certain property regardless of your current living arrangement.  However, the courts will make sure that the kids are protected first and foremost.

You've gotten yourself into a tough situation. I would suggest considering what is best for the children -- yours with your spouse and the new baby. Your decisions are affecting them.

my thoughts only: i don't think that u are intitled to anything, because u decided to leave your husband. and yes u do have to think of the children already with him in the house. the man that u are with now should take of your needs now..

IF your husband has custody of your children, just remember you will not be just taking away from your husband, but you will be taking away from your kids as well. I know from my divorce involving children, the courts will usually not disrupt or do anything, including taking away items from the home that the children are in, if it will not be in the best interest of the children.
