Can I Sue for emotional duress?

my wife took the kids and left me one day while I was at work. She moved back in with her parents that live 600 miles away from me. I was devastated and so distraught I ended up in the hospital. I also lost my job for over 4 months. Then when I filed for a divorce, she refused to sign the papers. I had to stop the divorce because I ran out of money for the lawyer. Then 2 weeks later she filed for divorce herself. Can I sue her for emotional duress and hardship. I now have over $30,000 dollars in hospital bills and lawyer fees due to her actions.

My friend, I felt like you did when my ex first left. Having gone through all of that and coming to where I am now, I can sum up my advice to you in three words:

Be a man.

Female is attracted to Male ... (straight) women are attracted to MEN. Men don't whine about being devistated and emotionally distraught. Women, feel free to call me chauvinist if you like, but you'll only understand this if you're a guy: SHE'S JUST A WOMAN. Regardless of how you feel about her being a soul mate or whatever, you need to realize that there are billions of women out there looking for a masculine man, a man who acts like he's got a pair. Be what they're looking for, and you'll eventually begin to realize that this is the best thing that could've happened to you. You're now free of the mistake you made marrying her, and can have your pick of the litter of any other woman out there.... just don't marry any of them. You learned your lesson :)

About your bills, I don't think those can go to collection or accrue interest as long as you're consistently paying on them. So, pay $10 or so each month on each bill, and forget about the $30k. At this point it's a sunk cost, and men don't cry over spilt milk. Use the courts to get whatever you're legally entitled to, and leave it at that. Don't let ANY woman rule your emotional life.... that's what football is for.

i don't think you can sue for emotional duress,but you can let this divorce happen as quickly as possible.   and then seek out counseling for yourself and try to move on. but you can also tell the courts you don't want your children living that far away from you.
