Post divorce suit

I did not use my own attorney in my divorce in 2005. I pretty much got 1% of our assets. I didn't fight it-it was a bad situation and I wanted out. Will I still get part of his 401k if it's not in the paperwork? Also, he has been suing me for over a year. He says I used his charge card without his consent AND that I try to use his name for credit. He married my brothers girlfrind 1 month after we divorced. A true shock to everyone! She is the driving force behind this.( A very spiteful young woman.) Is there anything I can do? I have asked the court to let us submit to a polygrapgh, but have received no reply. I have already paid out about as much as I got from the divorce settlement. He makes probably $80k a year, kept he house valued at approx.$250k with LOTS of equity and I got $5000 and my car-and now he wants money from me!! HELP! I'm losing my mind from this! I should not have to give him money to pay for his new wifes uncontrolled spending!!

I live in KY-wouldn't you have guessed it with my ex's Jerry Springer-like antics? Who marries their brother in laws girlfriend?? Yuck. He was, in fact, threatening me at times during the divorce. I lost about 20 pounds. I weight about 95 at the end! Yes, I am a lousy attorney! My attorney on this post divorce case is even worse! I keep paying and she keeps doing pretty much nothing!! I am running out of money to pay for this joke!  Also, I am in my mid-30's and just remarried. I am afraid to have a child as I may end up broke after my ex is through with me! I have no kids yet, btw. Also my ex works for a huge shipping company and gets FREE LEGAL SERVICES!!! He can sue me every day for 100 years without a penny from his pocket. He is asking the court for me to reimburse the legal costs so he can also pocket that money! Like I said, I left with nothing and really don't want anything but peace! If I wanted his $$ so badly, I could have fought for it in the divorce. I have done nothing to this man. His "wife" STILL calles my brother weekly, though he will not answer her calls. She stills wants him! SICK! It is very embarassing, but I just want help stopping this madness! Sigh.

the best thing you can do at this point and go back to court to amend parts of the settlement.  do you have kids?  child support can change yearly...depending on salary.

You are in a pickle fedupkel. Joel is right you NEED a lawyer. It's possible, depending on your State to have the entire property settlement set aside due to ineffective assistance of counsel.. that means, your first lawyer, which was you, was less than effective. I understand everybody is perfect and would rather die than admit a mistake but but there is money on the table and you would be well served to admit you're a lousy lawyer.

A second opportunity or cause to have the property settlement set aside is that it was incomplete and didn't address your ex's 401k.

A third cause would be undue influence. For example, you mentioned the proceedings and process were so stressful that you just wanted out. IF he was intentionally inflicting that stress you might have a cause to set aside the property settlement for "undue influence."

did I suggest you get a lawyer? Did Joel? Good luck and come back and let us know how it's working

If it was not previously put in the paperwork I do not think you have much claim to it now.  You need legal advice to find out what is going on with the new lawsuit now.  Hang in there.
