Rights over a house that Im not on the deed

I am trying to get a divorce I have 2 children ages 12, 8 my husband left us 4 years ago to go live with his girlfriend. I was trying to refinance the house for a lower intrest rate where me and my children live but beings that I was not on the the deed of the house when purchased "97" because I was still not married till after "99" 2 years I was unable to do so.What my question is what legal rights do I have over the house and my children when I do file for a divorce?

If you're in NYS then that house is a marital asset and part yours anyway.

I agree with brad, have your husband put the house in your name so you can refinance.

There are three basic rights when it comes to children;

1. Legal custody rights is who can make decisions such as medical and schooling.
2. Custody rights is who the children will live with.
3. Visitation rights to the non-custodial parent.

Often divorced spouses will share joint legal custody and one will be the primary custodial parent and the other enjoys visitation rights.

As to the house you might ask your spouse to quit claim it to you and refinance. If he won't the house will be resolved in the final settlement.
