Taxes & children

who gets to claim the children when doing taxes??? Children live with me but we have joint custody although he has the kids 6 days out of the month(every other weekend).

The Custodial parent is the one who qualifies to claim the child on federal taxes, check your state guidelines as those might be different, unless you sign the IRS Form 8332, giving the non-custodial the right to claim the child.

I was told that either parent can claim the children. It is a come first one serve thing. The children are staying with each parent through out the year on a part time bases. Even if they are in the military deployed away somewhere and haven't been with them they can still claim them. You just have to talk to your spouse and and decide on what to do. With me and my ex we have 3 kids so I claim 2 and he claims 1. My bother claims his child every other year. I got my information from the IRS about the tax and kids so go there and look up what you need. I hope this help.

that should have been determined during the divorce decree...and should be stated in there clearly. if it's not, then you two need to negotiate this and then get it written down somewhere, legally. there are formst that need to be filled out for this. whatever you do, don't mess with the IRS.
