No way to collect child support?

What, if anything, can I do to collect child support from my ex? He has not paid in four months. He does not hold a regular job - he works here and there, now and again, "under the table," so there are no wages to attach. I am not sure if I should go back to court, since I feel they could actually lower his obligation since his "official" income is zero. He is not disabled, he just chooses not to work. Am I just out of luck, or is there anything I can do?

If he is not paying to support his children, he is in violation of his current court order. Most states have provisions to address non-custodial parents who are able to work, but choose not to, or who are working "under the table." People who are working through informal channels, yet have the money to drive a car, pay rent or a mortgage, etc. are questioned by the court about their ability to live without income, and additionally become of interest to the IRS. It is conceivable that he could argue to have his child support obligation lowered, and may or may not be successful. Strategically, you may want to get into court and document his non-payment. Consult your attorney.

This is a very good question. I would make sure it is filed with the court that he is not paying child support. They can garnish future earnings. I would consult with your attorney to make sure. I hope this works out.
