Court. Notice of Motion and Motion to Modify Child Support

I have a court appearance on Thursday 11/5. My ex husband is taking me to court to reduce my child support. I am receiving $800 per month for one child and which is above the guidlelines. This is what we agreed upon. What should I expect from the court apprearance. What should I have with me? How should I be prepared. He filled out a sheet "Notice of Motion to Modify Child Support". He was fired from his job and appealed unemployment and is now receiving unemployment. Not all the information is correct to my knowledge. Will I have any opportunity to clarify my "case" or situation? %0d%0aThank you.

I'll tell you right now, he is going to get a reduction, at least temporarily, until he finds new employment. He can't afford $800 a month living on unemployment - and he has a legal right to request a reduction based on his change of circumstance - there is nothing you can do or say that will stop it from happening.

Yes you will be given a chance to state your position but you aren't walking out of there still getting $800. So be prepared for the next 6 months or so to tighten your purse strings.

Once he gets back to work you can file for an increase - but even then, unless he makes more than he did at the other job, I'm guessing he won't allow it to go over what guidelines state.
