Legal Fees

This one is for Spaz...

 

Ex husband filed for divorce. I hired a lawyer and paid the retainer. He basically screwed up and filed in the wrong court. He was suppose to take care of the screw up, thus he was responsible for the on-going lawyer fees.

 

I finally fired him. He was just wasting my time and the ex-lawyer's time. He was agreeing to things without asking me. I finally asked him if he was working for me or the ex? Really strange.

 

I just received a call from the ex's lawyer , 1 year later,  tells me that my ex lawyer owes her $1,200 and that she will set it up for trial and the court might force ME to pay for it...hmmm.

 

So here's my dilemna....do the right thing: 1) pay her....2) let the lawyer hang  himself for being such a careless lawyer.

 

Your thoughts on this one?

Contact the bar and file a grievience that you were just threatened with a lawsuit over fees he owes....they can take it off your hands for you & mediate between the two attorneys. I'm guessing your ex attorney feels what she wants as far as fees is rediculous so he's refusing to pay.

I fired him over the phone.  Secondly, he did file a motion to start over admitting that due to his negligence he filed in the wrong court.  

No grievance was filed against him.   I just wanted to put it behind me.

If you can prove that you let your ex attorney knew exactly why he was fired - and even better, if you reported a grievience with the bar...you aren't going to have anything to worry about as far as having to pay anything.

Your ex's attorney is being a bit of a bullying bitch really, slim chance a judge would even consider penalizing a wronged client for outstanding fees payable to the opposing counsel, she just wants her money and is trying to squeeze it out of whoever she can.

Hi VLady -  I know you posted this for Spaz, but I think attorneys carry legal malpractice insurance that is supposed to cover them for actions such as this.  If you have proof of your allegations or could get them, you might be able to file suit against your attorney for legal malpractice.

Martians are happy because they have no lawyers...................I sure wouldnot pay, why pay for irresponsibility?   I would not pay.

Spaz will know but I know that my lawyer drew up paperwork more than once that did not say what I had expressly stated I wanted it to say and I had to pay for the time for each correction. I believe that sucks but they basically have you over a barrel do they not?
