Lean on my house for child support owed to me???

There is a lean on my house for child support that is owed to me from the estate of my late ex-husband.

He did not leave a will.  I am the administrator of the estate.

Due the the divorce I have to split equity in the house with the estate.  The estate has not other assets.

 

My boys and I are living in the house that we can not sell due to market conditions.

I can not refinance the house due to the lean.

The child support is increasing every month and eventually will be more than 50% of the equity in the house.

 Has anyone had this same situation, it seems crazy to me!

This is why it is SOOOO important in a divorce process to ensure the marital home is truly and finally disposed of in the process (either by sale or by refinance). When someone's name is left on a home and something happens this is the result.

What you need to do is get to an attorney and have them file in court to "forgive" his estate of any past due or future owing child support. This will lift the lien (make sure that is stipulated in the order) and you will be free and clear to do what you need to do with the house.

I'm confused. the child support is increasing but it's owed TO you....so what's the problem?

Do you owe someone else child support or did your ex husband?
